Summary
Faceify Labs is a B2B SaaS platform for licensed medical professionals. Simulations are consultation tools — not surgical guarantees. Patient images never leave your device. Subscribers are responsible for patient consent; patients have full data rights under applicable privacy law. By using the Platform, all users agree to these Terms.
By accessing or using the Faceify Labs platform (the “Platform”), including any website, application, API, or related service operated by Faceify Labs Pvt. Ltd. (“Faceify Labs,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”).
If you are accessing the Platform on behalf of a medical practice, clinic, hospital, or other organization (“Organization”), you represent and warrant that you have the legal authority to bind that Organization, and that your acceptance of these Terms constitutes acceptance by the Organization.
If you do not agree to these Terms, you must immediately cease all use of the Platform. These Terms are effective as of the date you first access the Platform and remain in effect until terminated in accordance with Section 17.
The Platform serves two distinct user types, each with their own access pathway and obligations:
Medical Professionals (Subscribers & Authorized Users)
The full Platform is intended for use by licensed medical and aesthetic professionals, including plastic surgeons, cosmetic surgeons, dermatologists, maxillofacial surgeons, and aesthetic practitioners. By registering an account, you represent and warrant that:
Patient Users
Patient Users may access a limited view of the Platform only through a secure, time-limited invitation link provided by their treating Subscriber. Patient Users do not require a professional license, but must be of legal adult age in their jurisdiction, or have verifiable parental or guardian consent if under legal adult age. See Section 4 for full Patient User terms.
Faceify Labs reserves the right to verify credentials and to decline or revoke access to any individual who does not meet these eligibility requirements.
This section applies specifically to patients accessing the Platform.
4.1 — How Patients Access the Platform
As a Patient User, you access the Platform through an invitation issued by your treating medical professional (the Subscriber). Your access is scoped to viewing Simulations and related consultation materials prepared for you by your surgeon or practitioner. You do not independently create an account or upload images directly — this is managed by your medical professional on your behalf.
4.2 — What the Simulation Means for You
A Simulation is a visual illustration, not a promise of results. The AI-generated image you see during your consultation is intended to help you and your surgeon discuss what a procedure might look like. It is not:
Actual surgical results depend on your individual anatomy, your surgeon's technique, your healing response, and many other clinical factors that cannot be modelled in advance. Always discuss realistic expectations thoroughly with your surgeon before making any decision.
4.3 — Your Data & Privacy as a Patient
Your facial images never leave your device or your surgeon's device.The Platform processes all facial images locally in the browser using on-device AI — no images are uploaded to Faceify Labs' servers. This is a core architectural privacy protection.
If your surgeon or their clinic stores or shares your Simulation results as part of your medical record, that storage is governed by their own privacy practices and the healthcare regulations of your jurisdiction — not by Faceify Labs.
Faceify Labs may receive limited, non-identifiable data (such as session timestamps and feature usage events) to improve the Platform. This data cannot be used to identify you personally and is never linked to your images or clinical information.
4.4 — Your Rights as a Patient
Depending on your jurisdiction, you may have the following rights regarding your personal data:
To exercise any of these rights, contact us at ceo@faceifylabs.com. We will respond within 30 days. Please note that since patient images are never transmitted to our servers, erasure requests for imaging data should be directed to your treating medical professional.
4.5 — Minors & Parental Consent
If you are under the legal adult age in your jurisdiction (typically 18 years), you may only access the Platform with the verified consent of a parent or legal guardian. Your treating medical professional is responsible for verifying and documenting this consent prior to using the Platform in a consultation involving a minor. Faceify Labs does not knowingly collect personal data from minors without appropriate parental consent.
4.6 — Withdrawing Consent
You may withdraw your consent to the use of the Platform in your consultation at any time by notifying your treating medical professional. Withdrawal of consent will not affect the lawfulness of any processing already carried out before the withdrawal.
4.7 — Complaints
If you believe your data has been handled improperly, you have the right to lodge a complaint with the data protection authority in your country. You may also contact us directly at ceo@faceifylabs.com and we will work to resolve your concern promptly.
You are responsible for maintaining the confidentiality and security of your account credentials, for all activity that occurs under your account, and for ensuring that Authorized Users comply with these Terms.
You may not share account credentials with individuals who are not Authorized Users, and you may not allow any individual who does not meet the eligibility requirements to access the Platform using your credentials. Faceify Labs is not liable for any loss or damage arising from unauthorized account access due to your failure to maintain credential security.

Access to certain features of the Platform requires a paid subscription. By subscribing, you agree to:
Subject to these Terms and your subscription plan, Faceify Labs grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for lawful professional and clinical purposes.
You agree NOT to:
Simulations are illustrative tools, not medical predictions or guarantees of surgical outcome.
All AI-generated previews produced by the Platform are approximations generated for the purpose of facilitating patient-surgeon communication and consultation planning. They are not diagnostic tools, clinical recommendations, or surgical plans. Actual results will differ due to individual anatomy, surgeon technique, patient healing response, post-operative care, and other clinical, biological, and environmental factors.
Faceify Labs does not provide medical advice. The Platform is a professional tool designed to support, not replace, the clinical judgment of a qualified medical professional. All clinical decisions must be made exclusively by a licensed, board-certified medical professional following a proper clinical assessment of each patient.
You agree to use Simulations only as part of a broader clinical consultation process and to clearly communicate to patients the non-predictive, illustrative nature of any Simulation shown.
As a Subscriber, you bear full responsibility for obtaining and documenting appropriate patient consent before using the Platform in any patient-facing context:
On-Device Processing:All Patient Data (including facial images) is processed entirely within the patient's browser or the User's device using client-side AI models. No Patient Data is transmitted to or stored on Faceify Labs servers. This architectural protection does not eliminate your independent obligations as a data controller under Applicable Law.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
With respect to personal data processed through the Platform:
If you are located in a jurisdiction that requires a Data Processing Agreement (DPA), please contact us at ceo@faceifylabs.com to request a DPA addendum.
All rights, title, and interest in and to the Platform—including its software, algorithms, AI models, UI/UX design, branding, documentation, and Content—are and remain the exclusive property of Faceify Labs Pvt. Ltd. and its licensors. Nothing in these Terms transfers any ownership rights to you.
You may not, without prior written consent from Faceify Labs:
Feedback: If you provide suggestions, feedback, or ideas regarding the Platform, you grant Faceify Labs a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without any obligation to you.
The Platform may integrate with or rely on third-party services, including:
These third-party services operate under their own terms of service and privacy policies. Faceify Labs is not responsible for the practices of third-party providers.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND.
To the fullest extent permitted by Applicable Law, Faceify Labs expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement; any warranty that the Platform will be uninterrupted or error-free; and any warranty regarding the accuracy, reliability, or completeness of Simulation outputs.
Faceify Labs makes no warranty that Simulations accurately predict surgical outcomes for any particular patient, and expressly disclaims any responsibility for clinical decisions made in reliance on Simulation outputs.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FACEIFY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
This exclusion applies regardless of the legal theory and even if Faceify Labs has been advised of the possibility of such damages. Excluded damages include, without limitation: loss of revenue, profits, business, or data; harm to patients arising from clinical decisions informed by Simulation outputs; Platform downtime, data loss, or service interruptions; and unauthorized access to or alteration of your account or data.
In no event shall Faceify Labs' total aggregate liability exceed the greater of (a) the fees paid by you in the three (3) months preceding the event, or (b) USD 500.
You agree to defend, indemnify, and hold harmless Faceify Labs, its officers, directors, employees, contractors, and licensors from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform in violation of these Terms; (b) your violation of any Applicable Law; (c) any patient complaint or claim arising from your clinical use of Simulations; (d) your failure to obtain proper patient consent; or (e) any third-party claim arising from content you submit, upload, or transmit through the Platform.
Each party may have access to Confidential Information of the other party. Each party agrees to: (a) keep such information strictly confidential; (b) not disclose it to third parties without prior written consent; and (c) use it only for the purposes of these Terms.
These obligations do not apply to information that is publicly available through no fault of the receiving party, was rightfully known prior to disclosure, or is required to be disclosed by Applicable Law or court order.
These Terms are effective from the date you first access the Platform and continue until terminated by either party.
Termination by You: You may terminate your account at any time by contacting us or through your account settings. Termination does not entitle you to a refund of prepaid fees.
Termination by Faceify Labs: We may suspend or terminate your access immediately, with or without notice, if you materially breach these Terms, continued access poses a risk to patients or the Platform, required by Applicable Law, or you fail to pay subscription fees when due.
Effect of Termination: Your right to access the Platform ceases immediately. Sections 8, 11, 13, 14, 15, 18, and 19 survive termination.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute shall be subject to the exclusive jurisdiction of the courts of Mumbai, India. Faceify Labs may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for 30 days following written notice.
Unresolved disputes shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Mumbai, India; the language shall be English. The arbitral award shall be final and binding.
Faceify Labs reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the “Last updated” date, sending an email notification, and displaying a prominent notice within the Platform.
Your continued use of the Platform after the effective date constitutes acceptance of the changes. If you do not agree to revised Terms, you must stop using the Platform.
